Terms of Use
Last updated: [date]
1. Acceptance of these Terms
These Terms of Use ("Terms") are an agreement between you and Your Insurance Agency ("we," "us," or "our"), which operates this website. By accessing or using this site, or by submitting the quote form, you agree to these Terms. If you do not agree, please do not use the site.
2. Who we are
Your Insurance Agency is a licensed independent insurance agent (a sole proprietor). I am an insurance agent, not an insurance company. Ohio license number: [license #]. I am licensed in the State of Ohio. Policies are underwritten, issued, and serviced by the insurance carriers I represent, and claims are paid by those carriers, not by me.
3. Informational purpose; this is an advertisement, not an offer
This website is general information and an advertisement and solicitation for life insurance. Nothing on this site is an offer to sell, a policy, or a binder of insurance, and nothing here guarantees that any coverage will be issued. No coverage is in force unless and until an insurance carrier issues a policy and any required premium is paid.
4. Quote requests and rates
Any rates, coverage amounts, or examples shown are estimates only. Final eligibility, rates, and coverage are determined by the issuing carrier and are subject to application, underwriting, and carrier approval. Submitting the form is a request to be contacted, not an application for insurance.
5. No agent-client relationship until a policy issues
Using this site or submitting the form does not create any agency, fiduciary, or advisory relationship between you and us. A producer-client relationship arises only if and when an application is accepted and a policy is issued.
6. Eligibility
This site is intended for residents of the State of Ohio who are 18 years of age or older and located in the United States. By using the site, you represent that you meet these requirements.
7. Your contact information and consent
When you submit the form, you provide contact information and choose whether to consent to be contacted. That consent is presented to you at the form itself and is described in our Privacy Policy. Any consent to calls or texts is not a condition of purchase and may be revoked at any time as described at the form and in the Privacy Policy. We keep records of the consent you provide.
8. Privacy
Your information is handled as described in our Privacy Policy, which is incorporated into these Terms by reference.
9. Acceptable use
You agree not to use this site for any unlawful purpose, to submit false information or another person's information without authorization, to attempt to access areas of the site not intended for you, or to scrape, disrupt, or interfere with the site.
10. Intellectual property
The content, design, layout, and marks on this site are owned by or licensed to us and may be used only for your personal, non-commercial use. You may not copy, reproduce, or reuse them without our permission, except as allowed by law.
11. Third-party websites
This site may link to carrier or other third-party websites and tools (for example, a scheduling provider). We do not control and are not responsible for the content or practices of those third parties, which are governed by their own terms and policies.
12. Disclaimer of warranties
This site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including accuracy, availability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.
13. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, consequential, or punitive damages, or any loss arising out of your use of, or inability to use, this website. Nothing in these Terms limits any liability that cannot be limited under applicable law, including our responsibilities as a licensed insurance producer.
14. Dispute resolution: arbitration and class-action waiver
Attorney must finalize this section. The language below is a template. Whether it is enforceable depends on its exact wording and on the "I agree" step shown at the quote form. Have your Ohio attorney review and adjust it before you rely on it.
Please read this section carefully. It affects how disputes are resolved and limits your ability to bring a class action.
Informal resolution first. Before starting arbitration, you and we agree to first try to resolve any dispute informally. Either side may send the other a written notice describing the dispute and the relief requested. If it is not resolved within 30 days after that notice, either side may begin arbitration.
Binding individual arbitration. Any dispute arising out of or relating to these Terms, this website, or any calls, texts, or emails you receive after submitting the form, and that is not resolved informally, will be resolved by binding individual arbitration administered by a recognized arbitration provider under its consumer arbitration rules, rather than in court. The Federal Arbitration Act governs this section.
Class-action waiver. You and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate or join the claims of more than one person.
30-day opt-out. You may opt out of this arbitration and class-action- waiver section by sending written notice to the email or address in "Contact us" below within 30 days after you first submit the form. If you opt out, the "Governing law and venue" section applies to your disputes instead.
Small-claims exception. Either side may instead bring an individual claim in small-claims court if it qualifies.
Fees. We will pay the arbitration filing and administrative fees to the extent required by the arbitration provider's consumer rules or by applicable law.
Your right to contact regulators is not affected. Nothing in this section prevents you from contacting or filing a complaint with the Ohio Department of Insurance or any other government agency.
15. Governing law and venue
These Terms, and any dispute arising out of or relating to them or to your use of this site, are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. You and we consent to the exclusive jurisdiction and venue of the state and federal courts located in [County] County, Ohio, and waive any objection to that venue.
16. Your right to contact the Ohio Department of Insurance
Nothing in these Terms limits your right to contact or file a complaint with the Ohio Department of Insurance regarding an insurance matter.
17. Changes to these Terms
We may update these Terms from time to time. Changes apply going forward from the date they are posted, shown by the "Last updated" date above. Your continued use of the site after a change means you accept the updated Terms.
18. Severability; entire agreement
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding your use of this site.
